TERMS OF SERVICE

**Company:** Wasatch Front and Back Shuttle Service ("Company," "we," "us," or "our")

**Service:** Our web-based and mobile-accessible platform for scheduling, managing, and providing ride services.

By accessing, using, registering for, or booking a ride with Wasatch Front and Back Shuttle Service, you ("User," "Rider," or "Driver")

agree to these Terms of Service ("Terms"). If you do not agree, you must not use the platform or services.



1. Service Overview

Wasatch Front and Back Shuttle Service provides a platform that enables users to book transportation with independent drivers.

We do not own or operate vehicles directly. All transportation services are provided by independent third-party drivers who contract with the Company.



2. User Eligibility

  • Users must be at least 18 years old to register or schedule a ride.

  • By using our platform, you confirm all information you provide is accurate and complete.

  • We reserve the right to decline or remove any user or driver from the platform for any reason, including but not limited to violation of these Terms.



3. Driver Agreement

Drivers using the platform agree to the following:

  • You operate as an independent contractor and are not an employee, agent, or representative of the Company.

  • You are solely responsible for your vehicle, insurance, licensing, and compliance with all applicable laws.

  • You agree to accept ride assignments responsibly, maintain professional conduct, and provide safe and legal transportation services.



4. Ride Booking and Payment

  • Riders must provide accurate pickup and dropoff details, contact info, and payment method at time of booking.

  • Full payment is required at the time of booking via the platform's secure third-party payment processor.

  • Fares are calculated based on distance, time, and other applicable service charges.



5. Cancellation & Refund Policy

Cancellations by Riders:

  • More than 2 hours before ride: Full refund.

  • 2 hours before ride: 75% refund. Company retains 25% of the fare.

  • 1 hour or less before ride: Up to 50% refund. The Company retains 50% or more of the fare.

  • Less than 30 minutes / no-shows: Company may retain up to 100% of the fare.


**Note:** All refunds and retention percentages are at the sole discretion of the Company and may be adjusted based on cancellation history,

operational needs, or abuse of the system.

Cancellations by the Company or Driver:

If the Company or assigned driver cancels a ride, a full refund will be issued to the Rider. The Company will make reasonable efforts to notify

the Rider and assist with rescheduling if applicable.


6. Conduct & Behavior

Riders agree to:

  • Be on time and present at the scheduled pickup location.

  • Maintain appropriate conduct during rides (no smoking, illegal substances, violence, or disruptive behavior).

  • Comply with any reasonable instructions or policies set forth by the Driver or Company.



Drivers agree to:

  • Provide clean, roadworthy, and legally compliant vehicles.

  • Maintain professional, courteous conduct.

  • Arrive on time and communicate in the event of delay.



7. Liability Disclaimer

Wasatch Front and Back Shuttle Service provides a booking platform and does not assume any liability for:

  • Accidents, delays, injuries, losses, or damages sustained during rides.

  • Misconduct or negligence of Riders or Drivers.

  • Service disruptions due to traffic, weather, or acts of nature.



All services are provided "AS IS" without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties,

including merchantability and fitness for a particular purpose.



8. Limitation of Liability

Under no circumstances shall the Company, its owners, employees, contractors, or affiliates be liable for any indirect, incidental,

consequential, or punitive damages arising out of your use of the service.



9. Indemnification

You agree to indemnify, defend, and hold harmless Wasatch Front and Back Shuttle Service from any claims, losses, liabilities,

or expenses (including attorney fees) arising out of:

  • Your use or misuse of the platform

  • Your violation of these Terms

  • Any accidents, damages, or legal claims arising from a ride



10. Modifications to Terms

We reserve the right to modify or update these Terms at any time. Updated versions will be posted on our website. Continued use of the

platform constitutes acceptance of any revised Terms.



11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Utah. Any dispute arising under these Terms shall be resolved through binding

arbitration held in Salt Lake City, Utah, in accordance with the rules of the American Arbitration Association.



12. Acceptance of Terms

By checking the box at registration or booking, you confirm that you have read, understood, and agree to be bound by these Terms of Service.



13. Safety, Risk Acknowledgement, and Insurance Disclaimer

By using the Wasatch Front and Back Shuttle Service platform, Riders understand and agree to the following:

Transportation services are provided by independent drivers who are responsible for the safety, maintenance, and legality of their vehicles.

All Drivers are expected to carry valid personal and/or commercial auto insurance coverage as required by state or local law.

While the Company may verify basic driver information, we do not guarantee the availability, safety, or condition of any vehicle or service.

Riders voluntarily assume all risk associated with the use of the transportation services, including, but not limited to, vehicle accidents, personal injury,

delays, or loss of property.

The Company is not liable for any direct or indirect damages or injuries that occur during transport, except where required by law.

In no event shall the Company's liability exceed the total fare paid for the individual ride in question.

Riders agree that by using the Service, they waive the right to bring any class-action lawsuit, and agree to resolve disputes individually through

binding arbitration as detailed in this agreement.

IMPORTANT: Use of the service does not constitute a waiver of legal rights in cases of gross negligence, recklessness, or criminal behavior.



14. Driver Privacy and Information Disclosure

To protect the safety and privacy of individuals operating on the platform:

Wasatch Front and Back Shuttle Service does not guarantee or permit the disclosure of any personal information about Drivers, including but not limited to:

Driver's name

Phone number

Vehicle registration or license number

Driver's license or state-issued ID

Residential address or personal background

Riders agree that by using the platform, they waive any expectation of receiving identifying information about the Driver, except as may be

provided in ride summaries (e.g., first name or vehicle make).

Any requests for Driver-related information must be made through proper legal channels, such as a valid subpoena, court order,

or government agency request. The Company will comply with such requests only as required by applicable law.

The Company reserves the right to withhold, anonymize, or limit personal information in order to ensure the safety, privacy, and legal protection

of all users of the platform.

  • • Promptly notify the Company of any lapse, cancellation, or change in insurance coverage.

3. Responsibility and Liability

  • • The Driver acknowledges that they are solely responsible for the operation and condition of their vehicle and for complying with all laws and regulations.

  • • The Driver shall be fully liable for any injuries, damages, claims, or losses that occur while providing transportation services.

  • • The Driver agrees to indemnify, defend, and hold harmless the Company from any and all claims, actions, lawsuits, losses, damages, or expenses

  • (including attorney's fees) arising from or related to the Driver's services, vehicle, or conduct.

4. No Insurance Coverage by Company

  • • The Company does not provide auto insurance, commercial vehicle coverage, or liability insurance for any Driver or their vehicle.

  • • The Company shall not be held responsible for any loss, accident, injury, or damage sustained during transportation services.

5. Verification and Compliance

  • • The Driver consents to the Company verifying insurance information at any time.

  • • Failure to maintain required insurance or provide accurate information may result in suspension or removal from the platform.

  • • The Company reserves the right to update or amend insurance requirements at any time with reasonable notice.

6. Acknowledgment and Agreement

By signing below or checking the box during signup, the Driver acknowledges that they:

  • • Have read and understood this agreement.

  • • Agree to maintain valid insurance as described.

  • • Accept full responsibility for any incidents or claims arising from their services.

  • • Release Wasatch Front and Back Shuttle Service from liability in accordance with the terms stated above.
